This Privacy Policy (the “Policy”) describes how StupidFish (“StupidFish,” “Company,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise processes information in connection with our website(s), mobile application(s), and other online services that link to this Policy (collectively, the “Platform”), and related services provided through the Platform (the “Services”).
By accessing or using the Platform, you acknowledge you have read and understood this Policy. Where required by applicable law, you also consent to our collection, use, and disclosure of information as described in this Policy.
- SCOPE; DEFINITIONS
- Personal Information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.
De-identified Information means information that cannot reasonably be used to infer information about, or otherwise be linked to, a particular individual. We will maintain and use De-identified Information in de-identified form and will not attempt to reidentify it except as permitted by law.
This Policy does not apply to third-party websites, applications, or services that may be linked from the Platform.
- INFORMATION WE COLLECT
- We collect information from and about you through: (A) information you provide; (B) information collected automatically; and (C) information from third parties.
2.1 Information You Provide
Depending on your use of the Platform, we may collect:
• Identifiers and account information. Such as name, email address, password, and account settings.
• Profile and career information (“Public Profile Content”). Such as work history, education, skills, certifications, portfolio links, job preferences, goals, and other information you choose to include in your StupidFish profile.
• Communications. Such as messages you send through the Platform (if applicable), communications with customer support, and feedback you provide.
• Commercial information (if applicable). Such as billing address and transaction history. Payment card information is typically processed by a third-party payment processor.
You may choose not to provide certain information; however, doing so may limit your ability to access certain features or Services.
2.2 Information Collected Automatically
When you access or use the Platform, we may automatically collect:
• Device and network information. Such as IP address, device identifiers, browser type, operating system, language settings, and general location derived from IP address.
• Usage information. Such as pages/screens viewed, features used, clickstream data, session duration, and referring/exit pages.
• Cookies and similar technologies. We and our service providers may use cookies, pixels, SDKs, and similar technologies as described in Section 6.
2.3 Information From Third Parties
If you choose to connect third-party services (e.g., a professional networking service) or otherwise authorize a third party to share information with us, we may receive information you permit them to provide, subject to their terms and privacy policies.
- PUBLIC PROFILES; USER DISCLOSURES
3.1 Public Profiles
StupidFish permits you to create a public profile that may function as a digital resume. If you elect to make your profile public, the information you include in your public profile may be accessible to other users and visitors of the Platform.
Search engine indexing. Public profile pages may be indexed by search engines and may appear in third-party search results depending on Platform configuration and third-party indexing practices. We do not control third-party search engines or caches. Even after you edit or remove information from your public profile, copies of that information may remain visible for a period of time in cached or archived pages controlled by third parties.
3.2 You Are Responsible for What You Share
You are solely responsible for the content you choose to submit, publish, or otherwise make available through the Platform. If you choose to disclose Personal Information in your public profile, you do so at your own discretion and risk.
- HOW WE USE INFORMATION
- We process Personal Information for purposes including, without limitation, to:
- • Provide and operate the Platform and Services, including to create and administer accounts and profiles, maintain user settings, and provide customer support.
- • Improve, maintain, and develop the Platform, including to diagnose problems, test features, conduct analytics, and perform internal research and development.
- • Communicate with you, including sending administrative messages, security alerts, changes to policies or features, and customer service responses. You may not opt out of certain service-related communications.
- • Send marketing communications where permitted by law. You may opt out of marketing emails at any time via the unsubscribe mechanism provided.
- • Protect safety and integrity, including to detect, prevent, investigate, and respond to fraud, abuse, security incidents, and prohibited or illegal activities.
- • Comply with legal obligations and enforce our agreements, including our Terms.
We may also use De-identified Information for any lawful purpose.
- JOB OPPORTUNITIES; NO IN-APP APPLICATIONS
- StupidFish may present job-related information, links, or opportunities as part of the Services.
StupidFish does not support submitting job applications within the Platform. If you elect to pursue an opportunity, you may be directed to a third-party website (e.g., an employer site or applicant tracking system). Any information you provide to that third party is governed by the third party’s terms and privacy practices, not this Policy. We are not responsible for third-party privacy practices.
- COOKIES; ANALYTICS; INTEREST-BASED ADVERTISING
- We and our service providers may use cookies and similar technologies to operate the Platform, maintain sessions, remember preferences, analyze usage, and improve performance.
Where we engage in analytics or advertising measurement, we may collect information about your interactions with the Platform over time and across devices. If we engage in interest-based advertising or “targeted advertising” (as defined under certain state privacy laws), we will provide applicable opt-out mechanisms as required by law.
Cookie controls. Most browsers permit you to control cookies through browser settings. If you disable cookies, some features may not function properly.
Do Not Track. Some browsers transmit “Do Not Track” signals. The Platform may not respond to such signals.
- HOW WE DISCLOSE INFORMATION
- We may disclose Personal Information in the following circumstances:
7.1 Service Providers
We disclose Personal Information to vendors, consultants, and other service providers that perform services on our behalf (e.g., hosting, analytics, customer support tools, email delivery, payment processing). Such parties are authorized to use Personal Information only as necessary to provide services to us.
7.2 Public Disclosure (User-Directed)
If you make your profile public, we disclose the information you choose to include to the public consistent with your settings and this Policy.
7.3 Legal, Safety, and Enforcement
We may disclose information if we believe in good faith that such disclosure is necessary to: (a) comply with applicable law or legal process; (b) protect the rights, property, or safety of StupidFish, our users, or others; (c) prevent or investigate fraud, security issues, or violations of our Terms; or (d) respond to lawful requests from public authorities.
7.4 Corporate Transactions
In connection with any merger, acquisition, financing, reorganization, bankruptcy, sale of company assets, or similar transaction, Personal Information may be disclosed and/or transferred as part of that transaction.
7.5 Aggregated / De-identified Information
We may disclose De-identified or aggregated information for lawful purposes.
- DATA RETENTION
- We retain Personal Information for as long as reasonably necessary to fulfill the purposes described in this Policy, including to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, and maintain security. Retention periods may vary based on the nature of the information, the purpose of processing, and legal requirements.
- SECURITY
- We employ reasonable administrative, technical, and physical safeguards designed to protect Personal Information. However, no security measures are perfect, and we cannot guarantee that Personal Information will not be accessed, disclosed, altered, or destroyed by breach of any safeguards.
- INTERNATIONAL TRANSFERS
- StupidFish is operated from the United States. If you access the Platform from outside the United States, you understand that your information may be transferred to, stored in, and processed in the United States and other jurisdictions where we or our service providers operate, which may have data protection laws different from those in your jurisdiction.
- CHILDREN
- The Platform is not directed to children under 13 years of age, and we do not knowingly collect Personal Information from children under 13. If you believe a child has provided Personal Information to us, please contact us and we will take appropriate steps to delete such information.
- YOUR PRIVACY RIGHTS
- Depending on your state of residence and applicable law, you may have rights to:
- • Access/know the Personal Information we collect, use, and disclose;
- • Correct inaccurate Personal Information;
- • Delete Personal Information (subject to legal exceptions);
- • Portability (obtain a copy in a usable format);
- • Opt out of certain processing, such as targeted advertising and certain disclosures;
- • Non-discrimination for exercising privacy rights.
12.1 Submitting a Request
You may submit a request by emailing help@stupidfish.app. We may take steps to verify your identity and your request as permitted or required by law. Authorized agents may submit requests where permitted by law, subject to verification.
12.2 “Sale” / “Share” (as defined by certain laws)
We do not “sell” Personal Information for monetary consideration as that term is defined under certain state privacy laws. To the extent we engage in activity that constitutes “sharing” for cross-context behavioral advertising under applicable law, we will provide the right to opt out as required.
- THIRD-PARTY LINKS
- The Platform may contain links to third-party websites or services not operated by us. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing information.
- CHANGES TO THIS POLICY
- We may modify this Policy from time to time. Changes will be effective upon posting unless otherwise stated. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Policy, to the extent permitted by law. Where required, we will provide additional notice of material changes.
